Personal Data Notice (KVKK)

This legal notice is provided in English as a translation of the Turkish text.

Under Turkish Personal Data Protection Law No. 6698 (KVKK), the data controller is Mücahit Şen, an individual. Province/district: Bursa / Nilüfer, Türkiye. Contact: hello@lukeristudio.com.

Data that may be processed: user ID (uid) and sign-in provider; LMP and, if entered, baby name/selected sex; ultrasound, AI portrait, and memory photo/note, and week; subscription status; local reminders and permission and analytics preferences; and, when analytics are on, limited analytics events and technical app metadata.

This data is processed to provide accounts and sessions, sync profiles and content, generate AI portraits with explicit consent and ensure content safety, process subscription status, schedule notifications on the device, respond to requests, and anonymously measure product usage unless turned off in Profile. Ultrasound and portrait images, which qualify as health data, are processed with explicit consent. Images go through suitability and content checks with Vertex AI (EU multi-region); they may be transferred to an OpenAI image model through Wiro to generate portraits. This transfer may be made abroad; your explicit consent is obtained under Article 9 of KVKK. Subscription status is processed by a subscription management service using the user ID; payments and purchases take place through Apple or Google.

The source image is kept until the user replaces it or deletes their account; weekly portraits are kept until the account is deleted. When the account is deleted, the server deletes all user data in the cloud, as well as the customer record at the subscription service; it retries on failure. Wiro’s, OpenAI’s, and Google’s retention and training practices are governed by their own terms.

Under Article 11 of KVKK, you have the right to learn whether your personal data is processed; request information if it is processed; learn the purpose of processing and whether it is used in line with that purpose; learn the third parties to whom it is transferred in Türkiye or abroad; request correction of incomplete or inaccurate data and, when legal conditions are met, its deletion or destruction; request that these actions be notified to third parties to whom the data was transferred; object to a result against you arising from analysis exclusively through automated systems; and claim compensation for damage caused by unlawful processing. Data may be transferred to authentication, cloud storage and database, error-reporting, analytics, and subscription service providers (which may be located abroad), to Vertex AI (Google), Wiro, and OpenAI for the AI portrait, and, for purchases/payments, to Apple or Google. The processing of special-category health data related to the AI portrait and the transfer abroad are based on your explicit consent. You may send requests to hello@lukeristudio.com.
